What is included in the Listing?
The descriptions which form part of the list entries are not definitive schedules of all those elements which are legally protected but are, rather, intended to assist in identifying the buildings in question. Please note that, as addresses change over time, the only way of getting a definitive answer as to whether a building is listed is to provide a location map of the building(s) in question.
Does the Grade of the Listed Building make a difference to when consent is required?
No matter what the Grade, all Listed Buildings enjoy the same protection in Law and require an application for Listed Building Consent to be made for certain types of work. Carrying out works to a Listed Building without previously obtaining the necessary consent(s) is a criminal matter and could lead to enforcement action and/or prosecution where, if found guilty, those involved might expect a fine, imprisonment or both.
Does the Listing just refer to the Building in the description?
In addition to those buildings which specifically appear on the national lists, any buildings within the curtilage of a Listed Building which pre-date 1st July 1948, and are ancillary to the main use, are treated as if they are Listed in their own right. Such buildings might include garages, coach-houses, gate-lodges, barns, oast houses and even privies!
What do I need to be aware of if I am thinking of purchasing a Listed Building?
If you are a prospective purchaser of a Listed Building, please be aware that whilst we encourage people to contact us with any queries, availability of officer resources may mean we are not always able to offer specific advice about either possible alterations and/or additions, or unauthorised works which may have been carried out (and for which the new owner may become liable). With regard to the latter, you may wish to come into the Crowborough Office to check the previous planning history. If so, please contact the Information Officers on 01892 602510/602514 to advise them in advance of the time and purpose of your visit so that the necessary files can be made available.
NOTE: Estate Agents have been advised that a Compliance Check (to disclose any unauthorised works) which would also include basic comments about possible alterations, could be commissioned from the Conservation and Design section for a fee and you may wish to check with them whether this has been done.
